1. GENERAL CONTRACT CONDITIONS

A. Pre-employment information

VELATTI's contract with the user for the purchase of its products will produce all legal effects, when the consent and other requirements necessary for its validity, established in current regulations, concur.

The prices displayed in the online store may be reviewed and modified at any time. The prices of the products will appear in several currencies, for the convenience of the client.

All the prices of the products displayed on this website include VAT. The tax base plus VAT, broken down, will be found in the shopping cart at the end of the purchase, on the final invoice.


B. Information to the consumer on the exercise of the right of withdrawal

The exercise of the right of withdrawal under Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, taking into account the content of the Article 68 “The right of withdrawal from a contract is the power of the consumer and user to nullify the contract concluded, thus notifying the other contracting party within the period established for the exercise of that right, without the need to justify their decision and without penalty of any kind.

This means that the user can exercise the right to withdraw from the contract signed with the merchant, within a period of 14 (fourteen) calendar days without the need for any justification.

C. Exercise of the Right of Withdrawal

To exercise the right of withdrawal, the user must notify their decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by certified mail, or email). You can use the model withdrawal form that appears in this section.

I hereby inform you that I withdraw from the contract of sale of the following property: (essential information), indicating the following information:

  3. PRODUCT REFERENCE

It is essential to provide the following personal data. If they are not recorded, we will understand that the right of withdrawal cannot be exercised:

  1. Personal data of the consumer.
  2. Consumer's address.
  3. Consumer signature.
  4. Date of signature of the document.
  5. Date and product purchase document.

The withdrawal period will begin to count from the day the buyer received the order, or failing that, from the time the seller became aware of the purchase by the customer.

The right of withdrawal is subject to the following conditions:

  • The return of the products will not be allowed without the packaging or the packages in which it was sent, together with the guarantees and instructions of the product.
  • If you wish to return several products from the same order, they must be returned in the same shipment, returns of the same order not being accepted separately.
  • The products must be in their packaging and with the guarantee seals intact.
  • Not having passed the period of 14 (fourteen) calendar days, from the acceptance of the purchase.
  • If the product does not meet the conditions mentioned above, an email will be sent to you, arguing that the exercise of the Right of Withdrawal is not appropriate.

VELATTI will retain the amount of the refund until the merchandise has been received at the following address: C/. Frederic Mompou, 3, 2B, 08960- Sant Just Desvern - Barcelona, Spain.
Return costs will be borne by the customer.
In the event that the return is made with another transport company other than the one contracted by VELATTI, in no case is it responsible for the loss of the package, or for the state in which it arrives. In case of loss of the merchandise, or if there is damage to the merchandise, the customer must bear the costs of the refund and the lost or damaged product, where appropriate.
If the buyer observes upon receipt of the package, that it was not properly closed or it was broken, the buyer must leave a written record of the fact on the delivery note, and inform by e-mail to web@velatti.com at least of 24 hours to VELATTI, to proceed to demand the possible claims.
In the event that the client does not make any claim within 24 hours of receiving the product, VELATTI will understand that the package was received in correct conditions, and no claim for damage to the package will be accepted after the aforementioned period.
The right of withdrawal cannot be exercised for those purchases made in a personalized way for the client, such as engravings, personalized jewelry, exclusive orders.

D. Consequences of withdrawal

If the customer's right of withdrawal is accepted by VELATTI having fulfilled all legal requirements, all payments received by the customer will be returned, excluding courier costs, without any undue delay and from the date on which the that we be informed of your decision to withdraw from this contract, as long as you have exercised your right within a period of 14 (fourteen) calendar days.

In the event that the client exercises the Right of Withdrawal, he will bear the return costs.

We will proceed to make said reimbursement using the same means of payment used by the client for the initial transaction, unless expressly provided otherwise, in a reasoned manner.

2. ORDERS AND PURCHASES

VELATTI provides, in a clear and understandable way, accurate and sufficient information about the characteristics of its products. That is why the products put up for sale offer the maximum guarantee, both from a technical and legal point of view.

The online purchase service through this portal is regulated in these Particular Conditions, subjecting the purchase of products to the following particularities:

  • Contracting users must be over 18 years of age.
  • The orders of the portal will be previously requested by the client, to the owner of the website, by accessing the shopping cart.
  • Once the purchase request has been made by the customer, it will be confirmed in writing by digital means and in an email account provided by the customer.
  • Once the order has been confirmed, the price to be paid by the client will be indicated on the order form together with the corresponding taxes and postage.
  • Once the order confirmation has been sent by the seller, the contract will be understood to have been concluded and it will be executed in accordance with the general contracting conditions specified in point one.

3. SHIPPING

Your order will be shipped within 24 business hours of receiving your order confirmation email. This may vary during sales or promotional seasons. Saturdays, holidays and local holidays are excluded for the shipment of orders.

  • For orders not available in stock, the term will be a maximum of 30 days; If it is higher, we will inform the client of the new estimated term.
  • Confirmation of payment will initiate the commitment of the delivery service.
  • If you think your order is running late, you can contact our customer service team.

We are not responsible for those factors external to VELATTI that may delay or prevent a delivery and are not covered by our logistics partners.

VELATTI reserves the right to vary the type of shipment and the company by which the merchandise is transported, as long as it does not cause obvious damage to the customer.

The user is informed that, at the time of delivery of the merchandise, if he is absent, an attempt will be made to make a subsequent delivery, but if a third delivery has to be made at the customer's address, the postage will be at his own expense. and exclusive charge, or you must go to the delegation of the delivery company that corresponds to you by proximity, to proceed with the collection of the order

VELATTI reserves the right to modify, temporarily suspend or cancel the service at any time. You will also have the right to reject those purchases that do not pass the security controls established in your electronic commerce systems, and in the security systems of the payment service providers, that you have contracted for the management of payments on this Portal.



SHIPPING CONDITIONS AND DELIVERY TIMES:

Saturdays, holidays and local holidays are excluded for the shipment of orders.
For orders not available in stock, the term will be a maximum of 30 days; If it is higher, we will inform the client of the new estimated term.
Confirmation of payment will initiate the commitment of the delivery service.
Shipments to post office boxes will not be accepted.
Estimated time in the delivery of the product:
Peninsular Spain: If the order is placed before 5:00 p.m., the shipment to the customer will be sent within 72 hours after the order is placed. Orders placed after 5:00 p.m. will start counting from the next business day.

European Union: 2-4 business days, depending on the destination.

United States: 2-4 business days, depending on the destination.

Rest: 2-5 working days, depending on the destination

Orders placed on Saturdays, Sundays and local or national holidays will be processed the next business day.
VELATTI reserves the right to vary the type of shipment and the company by which the merchandise is transported, as long as it does not cause obvious damage to the customer.

4. PAYMENT METHODS

For the payment process, the services of third parties unrelated to it are used and, in particular, the following payment service:

  • VISA/ MASTERCARD/AMERICAN EXPRESS
  • PAY-PAL

All means of payment are made through the electronic payment gateway system of the BBVA financial institution, which functions as a virtual point of sale terminal. VELATTI of said service will ask the user for certain data to make the payment, according to the payment methods that it offers.

Once the payment process has been successfully completed, the contract will be understood to be concluded and VELATTI will confirm such contracting by email, in accordance with Law 34/2002, of July 11, on services of the information society and electronic commerce. .

Customer Service:

In accordance with the Law of Consumers and Users, as they are contracts outside a commercial establishment, VELATTI makes available to its clients a means of truthful and economical information.

    5. RETURNS AND CHANGES OF PRODUCTS

    The term to return the articles is 30 (thirty) days, after receiving the order. The order delivery policy and possible product changes will be governed by the following rules:

    1. VELATTI reserves the right to modify, temporarily suspend or cancel the service at any time.
    2. VELATTI is not responsible for possible errors that may arise from computer system failures, or from human errors that may be caused, in billing, product sales or commercial communication. In which case, they will be rectified objectively, without giving rise to compensation or additional payments to the client, and the user will be offered the possibility of placing a new order or withdrawing from it, returning the money, to the client, who had paid in the initial purchase, if any.
    3. If for reasons not attributable to VELATTI, force majeure or an error in accounting for the stock, and an unavailable product is put up for sale, and it is purchased by a user in the online store, VELATTI undertakes to act in good faith and offer the user one of the following possibilities:
    • Reimburse the amount that the customer would have paid for the purchased product, without any compensation to it, through the same for which the payment was made.
    • Replace with another model, of equal quality and value, available in stock, with the prior consent of the customer.
    • If there is a possibility of having the same product, in a later period, send it in a new delivery term, previously agreed with the client. If not, the amount paid to the client would be returned, in case of not being satisfied.

    6. HIRING AND REGISTRATION PROCEDURE

    Before contracting, the client will have at his disposal on the portal the information regarding the procedures that must be followed to conclude the electronic contract for the sale of products or services through the Service.

    The online purchase procedure consists of several phases:

    1st Phase: Choose the products displayed in the online store, by the user.

    2nd Phase: Fill in the necessary personal data, in the section available on our website http://www.velatti.com of the corresponding form, to proceed with the on-line purchase.

    3rd Phase: Confirmation of the order, by the client.

    4th Phase: Payment, where all the amounts to be collected, including taxes, will be stated. Moment in which the contract is perfected under Law 34/2002, of July 11, on services of the information society and electronic commerce.

    5th Phase: Shipping of the products chosen by the user, which corresponds to the seller.

    For the online purchase process, the necessary data will be required to carry out the execution and control of the purchase, including the delivery of the product and the payment of the price.

    The billing data will be those that appear in the user's record. VELATTI is not responsible for the errors made by the user in the data provided to us for the purchase, and the user must pay special attention to the completion of the forms and, without prejudice, to the possibility of correcting said data after the completion of the purchase.

    If the user enters erroneous data during the purchase process and its correction gives rise to expenses, VELATTI reserves the right to charge the User for said expenses or to cancel the requested purchase.

    7. APPLICABLE LAW AND JURISDICTION

    The use of the VELATTI website and the product purchase contracts through said website will be governed by Spanish law.
    Any controversy that arises or is related to the use of the website or with said contracts will be submitted to the non-exclusive jurisdiction of the courts and tribunals of the Client's domicile.
